Terms of Use

Welcome to Etamen ("the App"), a caregiving platform designed to connect individuals who need care with their caregivers. By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms"). Please read them carefully.

1. Acceptance of Terms

By registering for or using Etamen, you confirm that you are at least 18 years old (or have parental/guardian consent), that you have read and understood these Terms, and that you agree to comply with them. If you do not agree, please do not use the App.

2. Description of Service

Etamen provides a mobile platform that includes:

• Daily check-in ("I'm OK") signals between care beneficiaries and caregivers
• Emergency SOS alerts with real-time GPS location sharing
• Live location tracking and movement history
• Voice note messaging
• Medication schedule management and low-stock alerts
• Buzz/ping reminders between caregivers and beneficiaries
• Battery level monitoring
• Safe-zone geofence breach notifications

Etamen is a communication and coordination tool. It does not provide medical advice, emergency dispatch services, or replace professional medical or emergency care.

3. User Accounts and Roles

You must create an account to use Etamen. You are responsible for maintaining the confidentiality of your credentials. Two roles exist within the App: Caregiver and Beneficiary. A caregiver manages one or more beneficiary profiles; a beneficiary sends check-ins and SOS signals to paired caregivers. You are responsible for ensuring that pairing codes are shared only with trusted individuals.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any regulations
• Impersonate another person or falsify account information
• Misuse the SOS feature by sending false emergency alerts
• Track or monitor any individual without their knowledge and consent
• Attempt to reverse-engineer, decompile, or tamper with the App
• Use the App in a way that could damage, disable, or impair our services

5. Location and Sensitive Data

The App uses GPS location data and stores health-related information (medical conditions, medications). This data is used solely to provide the App's features. Medical records are stored in the device's encrypted secure keychain and are not sent to any external server unless you explicitly initiate a sync action. Location data is relayed to paired caregivers in real time when location sharing is active. By enabling these features, you consent to this data processing.

6. Emergency Disclaimer

Etamen is not an emergency service. SOS alerts are delivered to paired caregivers via push notifications, which depend on internet connectivity and device availability. Do not rely solely on Etamen in a life-threatening emergency — always contact your local emergency services (e.g., 911, 999, 112) directly.

7. Intellectual Property

All content, logos, software, and design elements in Etamen are owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Privacy

Your use of Etamen is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

9. Subscriptions, Free Trial, Billing, and Refunds

Etamen offers an optional paid subscription ("Etamen Pro") that unlocks premium features. The safety core — SOS, "I'm OK" check-in, and missed-check-in alerts — is always free and is never gated behind a subscription.

• Free trial. New Pro subscriptions begin with a one (1) month free trial. You will not be charged during the trial period, and you may cancel at any time before it ends to avoid any charge.
• Automatic renewal. Unless you cancel before the trial ends, your subscription automatically converts to a paid subscription and the applicable fee is charged to your payment method at the end of the trial. Thereafter, the subscription automatically renews at the end of each billing period (for example, monthly or annually, according to the plan you selected) and the fee is automatically charged to your payment method until you cancel.
• Cancelling. You can cancel your subscription at any time from the Subscription screen in the App. When you cancel, automatic renewal is turned off and no further charges are made.
• Access after cancellation. If you cancel, you keep full access to Pro features until the end of the billing period you have already paid for. Access ends when that period expires; it does not stop immediately.
• No refunds. All payments are non-refundable. Cancelling does not entitle you to a refund or a partial refund for the current or any prior billing period, including unused time. This applies to the full extent permitted by applicable law.
• Payments and taxes. Payments are processed by our third-party payment provider (Creem), which acts as merchant of record and may collect applicable taxes (such as VAT or sales tax) in addition to the displayed price. Prices and available plans may change; any change applies only to future billing periods, and we will notify you in advance where required.

10. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, error-free, or timely delivery of notifications or location data. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the App.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of the applicable jurisdiction.
